Terms of Use
Approved by the owner of Xcelerent Pty Ltd. These words have not been reviewed by a lawyer.
Who provides the tools
DwellDelta is a service of Xcelerent Pty Ltd (ABN 14 701 983 995). In these terms, "we" means Xcelerent Pty Ltd. Contact: hello@dwelldelta.com.au.
What these terms cover
- The free tools on this website: the rent check, rents and sale prices by area, and the listed trust gaps.
- The data files this website publishes for anyone to download.
- The DwellDelta MCP server, which lets an AI assistant use the same data: the
dwelldelta-mcppackage that runs on your own computer, and the hosted server atmcp.dwelldelta.com.au, which is not running yet. The MCP server page describes both.
Using a tool, a data file or the server means you accept these terms. If you choose to add your rent, the Contributor Terms apply as well. The Privacy Notice says what we collect and keep.
Free, with no account
The tools, the data files and the MCP server are free. There is no sign-up and no account.
Information, not advice
Everything the tools and the server give is general information, not financial, legal or tenancy advice. No figure is a valuation of any home, an asking price or a forecast: a median describes many homes, never one. The rent check says nothing about what a tenancy tribunal would decide. Check a figure against its source, and get advice that fits your own situation, before you rely on it for a decision.
Where the data comes from
Every figure comes from a public source and keeps that source's attribution, which each page, data file and answer states with it. Figures under an open licence keep that licence too, and their data files name it; the trust gaps file, whose figures are used under ASX's permission, gives ASX's attribution instead.
- Most of the data is published by Australian governments under Creative Commons Attribution licences (CC BY 4.0, or CC BY 3.0 AU for some indicators and for the NSW suburb boundaries): among them the Australian Bureau of Statistics, the NSW Department of Communities and Justice, NSW Spatial Services, Homes Victoria, the Residential Tenancies Authority (Queensland) and the Government of Western Australia.
- The cash rate is a Reserve Bank of Australia figure, used under the RBA's permission for personal or commercial use; no endorsement by the RBA is implied.
- The listed trust gaps are based on ASX data, used with ASX's permission, and calculated by DwellDelta.
- Where DwellDelta has selected, combined or calculated figures - the Western Australian medians, for example - the data file says so in its own words.
If you reuse a figure, give it with its period and its source's attribution, as each file asks, and say what DwellDelta selected or calculated. For figures used under a publisher's permission rather than an open licence - the RBA cash rate and the ASX figures - check that publisher's own terms before you reuse them.
The MCP package's code is open source under the MIT licence, which comes with the package. That licence covers the code, not the data it serves.
Using the tools fairly
Use the tools as a person, or an assistant working for one, normally would. Please do not:
- try to get around a limit, such as the size of a request or how many requests the hosted server takes at once;
- overload, probe or attack the website or the server, or try to reach any part of them that is not offered to you;
- copy the website or the data by sending large numbers of requests: every data file is published whole, so download the file instead (llms.txt lists the addresses of the main ones);
- present a figure as DwellDelta's view of what a particular home is worth, or as something DwellDelta did not say;
- use the tools for anything unlawful.
We may limit or block use that breaks these terms. We may change, pause or stop any tool, data file or the server.
Your AI assistant
When you use DwellDelta through an AI assistant, the assistant is someone else's service. It decides what to ask the server and how to word the answer, and it can get things wrong. Each answer names the source, period and licence of its figures: check a figure against them before you rely on it. What the assistant does with your conversation is covered by its provider's terms and privacy policy, not ours.
No warranty
The tools are free and provided as they are. We take care, but publishers revise their figures, files can fall behind and we can make mistakes. So we do not promise that any figure is accurate, complete or current, or that the tools or the server will always be available. Nothing in these terms excludes a right you have under the Australian Consumer Law.
Limits on our liability
To the extent the law allows, Xcelerent Pty Ltd is not liable for any loss or damage that comes from using the tools, the data or the server, or from relying on them.
Reporting a problem or a security issue
Email hello@dwelldelta.com.au. If you find a security weakness, please tell us there before you tell anyone else, and do not use it beyond what you need to show it to us.
Changes
We will date every version of these terms and say what changed. A new version applies from its date.
The law that applies
These terms are governed by the laws of New South Wales.
